Filing a DMCA Takedown Notice

Before submitting a notice, please consider whether the material constitutes Fair Use (e.g., use for cybersecurity research, commentary, or news reporting). As a threat intelligence platform, much of the content we host is intended to document criminal infrastructure and is protected under these principles.

If you are a copyright owner or an agent thereof and believe that any content hosted on our services infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL).
• Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Procedure

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice to our Copyright Agent. Your counter-notice must include your physical or electronic signature, identification of the content that has been removed, and a statement that you have a good faith belief that the content was removed as a result of mistake or a misidentification. Upon receipt of a valid counter-notice, we may, at our discretion, send a copy to the original complaining party and inform them that we may replace the removed content in 10 business days.

Policy on Repeat Infringers

In accordance with the DMCA and other applicable law, PhishDestroy has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Response Timeline

We aim to acknowledge receipt of valid DMCA notices within 48 hours and take appropriate action promptly. Counter-notifications are processed in accordance with the statutory 10-14 business day waiting period before content may be restored.

Important Notes

PhishDestroy is an anti-phishing project. The vast majority of content we host consists of threat intelligence reports, domain analysis data, and security research published in the public interest. This content is published under the MIT License and is intended to protect internet users from fraud. DMCA notices filed against legitimate security research or threat reports may be subject to counter-notification and public documentation.

Abuse of Process: We closely monitor for "Bad Faith" DMCA notices — those filed to suppress security research, hide evidence of fraud, or silence criticism. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. PhishDestroy reserves the right to publish and archive all DMCA notices received to maintain a public record of censorship attempts.

Sanctions Compliance

In compliance with U.S. law and our internal mission, PhishDestroy does not process DMCA notices or legal requests from authorities, entities, or individuals located in the Russian Federation or other jurisdictions under comprehensive international sanctions.
