Our Stance on Copyright

PhishDestroy respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). We expect the same from our users and contributors. This policy outlines the procedure for copyright holders to notify us of alleged infringements.

Filing a DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on our services infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send all DMCA notices to our designated agent at dmca@phishdestroy.io. Falsely claiming that material is infringing may subject you to liability for damages.

Counter-Notification Procedure

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice to our Copyright Agent. Your counter-notice must include your physical or electronic signature, identification of the content that has been removed, and a statement that you have a good faith belief that the content was removed as a result of mistake or a misidentification. Upon receipt of a valid counter-notice, we may, at our discretion, send a copy to the original complaining party and inform them that we may replace the removed content in 10 business days.

Policy on Repeat Infringers

In accordance with the DMCA and other applicable law, PhishDestroy has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
