Our Policy

PhishDestroy respects the intellectual property rights of others and expects our users to do the same. We will respond to clear notices of alleged copyright infringement in accordance with the DMCA.

Filing a DMCA Notice

If you believe your copyrighted work has been infringed on our website, please send a written notice to our designated DMCA agent at dmca@phishdestroy.io with the following information:

  • Identification of the copyrighted work: Describe the work you claim has been infringed
  • Identification of infringing material: Provide URLs or specific location of the allegedly infringing content
  • Contact information: Your name, address, phone number, and email address
  • Good faith statement: A statement that you have a good faith belief that the use is not authorized
  • Accuracy statement: A statement that the information is accurate and you are authorized to act
  • Physical or electronic signature: Your signature or authorized agent's signature

Please make sure your claim is legitimate—we deal with enough fake claims from scammers trying to abuse the system.

Requirements for Valid Notices

Your DMCA notice must:

  • Be submitted by the copyright owner or authorized agent
  • Include all required information listed above
  • Be sent in writing (email is acceptable)
  • Be signed physically or electronically
  • Specify the exact content that allegedly infringes

Our Response Process

Upon receiving a valid DMCA notice, we will:

  • Review the notice for completeness
  • Remove or disable access to the allegedly infringing content
  • Notify the user who posted the content
  • Document the takedown action
  • Respond to the complainant within a reasonable time

We respond to legitimate DMCA notices faster than scammers respond to anything official.

Counter-Notification Procedure

If you believe your content was removed in error, you may file a counter-notification including:

  • Identification of content: Description of the content that was removed
  • Location information: Where the content appeared before removal
  • Good faith statement: Statement that you believe the content was removed in error
  • Consent to jurisdiction: Agreement to accept legal jurisdiction
  • Contact information: Your name, address, and phone number

Repeat Infringer Policy

We maintain a policy of terminating accounts or access for users who are repeat infringers of copyrighted content. This includes:

  • Users with multiple valid DMCA complaints
  • Accounts that repeatedly post infringing content
  • Users who abuse our platforms for copyright infringement

Safe Harbor Provisions

We qualify for DMCA safe harbor protections as a service provider by:

  • Designating an agent to receive DMCA notices
  • Responding promptly to valid takedown requests
  • Maintaining a repeat infringer policy
  • Not having actual knowledge of infringement

False Claims and Perjury

Making false claims in a DMCA notice or counter-notification may result in liability for damages, including costs and attorney fees. Knowingly making false statements constitutes perjury under federal law.

Don't file fake DMCA claims—we have enough problems with scammers without legitimate people making false reports.

Fair Use Considerations

Before filing a DMCA notice, consider whether the use might qualify as fair use under copyright law. Fair use may include:

  • Commentary, criticism, or parody
  • News reporting or educational use
  • Research or scholarship
  • Transformative or limited use

International Considerations

While the DMCA is US law, we extend similar protections to copyright holders worldwide. International copyright claims will be evaluated under applicable international treaties and agreements.
